Morris I. Berger is a Partner in the Firm’s Advisory Services division. During the course of his professional career‚ Mr. Berger has been engaged by attorneys and trustees to assist with commercial transactions‚ represent debtors and creditors in leading bankruptcy cases‚ structure out-of-court workouts and assist with state court actions involving the assignment of assets for the benefit of creditors. In addition‚ Mr. Berger has represented trustees in bankruptcies‚ examiners in bankruptcy cases‚ assignees in assignment for benefit of creditor cases‚ receivers in both federal and state court proceedings‚ secured creditors‚ parties in fraudulent conveyance actions‚ debtor and creditor committees in Chapter 11 cases and grievance committees for the Florida Bar in misappropriation of trust fund matters. Mr. Berger has conducted investigations in conjunction with the FBI‚ the IRS‚ the Department of Treasury and the U.S. Attorney’s Office.
A qualified expert witness in numerous federal‚ state and bankruptcy court cases‚ Mr. Berger has been appointed on various occasions to be a special disbursing agent for a liquidating trust and to perform special investigations and forensic accountings in a wide range of adversary proceedings. He has been appointed receiver in a state court action instituted by a lender‚ and examiner with expanded powers in several cases including the Chapter 11 filing of an electronics store chain with sales in excess of $50 million. In addition‚ he was appointed examiner with expanded powers and subsequently‚ liquidating trustee‚ in the Chapter 11 filing of a wholesale seafood company with sales in excess of $40 million.
Mr. Berger has been called on by the court and engaged by attorneys to perform forensic accountings‚ financial investigations and valuations.
